Sandunes Rental Cars

Welcome to Sandunes Rental Cars. These Terms and Conditions govern the rental and use of vehicles provided by Sandunes Rental Cars in Fiji. By making a booking or renting a vehicle, you agree to comply with the following terms.

1. Booking and Reservations

• All vehicle bookings are subject to availability and confirmation by Sandunes Rental Cars.
• Customers must provide accurate personal information and valid driving documents when making a reservation.
• A booking is confirmed only when the required confirmation and any applicable deposit have been received.
• Sandunes Rental Cars reserves the right to decline a booking where reasonable grounds exist, including failure to meet rental requirements.
• Vehicle models may be substituted with a comparable vehicle if the reserved vehicle becomes unavailable.

2. Driver Requirements

• The renter must hold a valid driving licence recognised for use in Fiji.
• International visitors must provide any additional driving documents required under applicable Fiji law.
• The minimum driver age is [insert minimum age], subject to applicable legal requirements and any additional licence conditions.
• Additional drivers must be declared, approved and recorded in the rental agreement before driving the vehicle.
• The renter must provide valid identification and any other documents reasonably required to complete the rental.

3. Rental Charges and Payment

• Rental charges will be communicated to the customer before the rental is confirmed.
• Payment must be made according to the agreed booking arrangements.
• A security deposit of FJ$[insert amount], if applicable, may be required before vehicle collection.
• The renter is responsible for additional charges incurred during the rental, including approved extensions, late returns, fuel shortages, traffic fines, tolls where applicable, cleaning charges and damage costs, in accordance with the rental agreement.
• Any applicable additional fees will be communicated to the renter before the rental begins, where practicable.
• Security deposits will be refunded after the vehicle has been returned and inspected, subject to any legitimate deductions permitted by the rental agreement and applicable law.

4. Vehicle Collection and Return

• The vehicle must be collected and returned at the agreed location and time.
• The renter must inspect the vehicle and report any existing damage before departure.
• Existing damage should be recorded in the vehicle inspection report or with dated photographs.
• The vehicle must be returned in substantially the same condition as supplied, allowing for normal wear and tear.
• Late returns may incur additional charges in accordance with the agreed rental terms.
• Rental extensions must be requested and approved before the original return time. Approval is subject to availability.
• The renter must return the vehicle with the agreed fuel level and all supplied keys, accessories and documents.

5. Permitted Use of the Vehicle

The renter agrees to:

• Drive safely and obey all Fiji road rules and traffic laws.
• Use the vehicle only for lawful purposes and within any agreed geographical or usage restrictions.
• Take reasonable care of the vehicle and secure it when unattended.
• Ensure that only authorised drivers operate the vehicle.
• Immediately report mechanical issues, warning lights, accidents or damage to Sandunes Rental Cars.

The vehicle must not be used for:

• Illegal activities or unauthorised commercial transport.
• Racing, speed testing or other dangerous driving activities.
• Driving under the influence of alcohol, drugs or any substance that impairs driving.
• Subleasing, lending or transferring the vehicle to an unauthorised person.
• Off-road driving or travel on unsuitable roads where prohibited by the rental agreement or vehicle restrictions.
• Any activity that breaches the vehicle’s insurance conditions or applicable law.

6. Fuel, Cleaning and Vehicle Care

• The renter must follow the agreed fuel policy.
• Incorrect fuel use or avoidable damage caused by misuse may result in charges for reasonable repair and recovery costs.
• The vehicle must be returned in a reasonably clean condition.
• Excessive dirt, stains, smoke residue, pet-related mess or other unusual cleaning requirements may incur a reasonable additional cleaning fee if disclosed in the rental agreement.
• Smoking or vaping inside the vehicle is prohibited unless expressly permitted in writing.

7. Accidents, Damage and Theft

• The renter must notify Sandunes Rental Cars as soon as reasonably possible after an accident, theft, attempted theft or damage.
• Where required, the renter must notify the police and obtain an incident or police report.
• The renter must not admit liability, agree to a settlement or authorise repairs on behalf of Sandunes Rental Cars without approval, except where immediate action is reasonably necessary for safety or to comply with the law.
• The renter must cooperate with any investigation and provide accurate information about the incident.
• Responsibility for damage, loss, recovery costs and any insurance excess will be determined by the rental agreement, applicable insurance policy and Fiji law.
• The renter will not automatically be responsible for every loss or damage; liability will depend on the circumstances and applicable terms and law.

8. Insurance and Liability

• Available insurance cover, exclusions, excess amounts and conditions will be explained before the rental begins.
• Insurance coverage is subject to the relevant policy terms and does not necessarily cover every type of loss or damage.
• The renter may be responsible for an applicable insurance excess or losses not covered by insurance where permitted by the rental agreement and applicable law.
• Sandunes Rental Cars will not exclude or limit liability where doing so is prohibited by Fiji law.
• Nothing in these Terms and Conditions removes any non-excludable rights or protections available to customers under applicable law.

9. Breakdown and Roadside Assistance

• If the vehicle develops a mechanical problem, the renter must stop in a safe place where necessary and contact Sandunes Rental Cars for instructions.
• The renter must not arrange major repairs without authorisation, except where emergency action is reasonably necessary.
• Roadside assistance, replacement vehicles and recovery arrangements are subject to the services included in the rental agreement.
• Costs arising from misuse, negligence or unauthorised repairs may be charged to the renter where permitted by the agreement and applicable law.

10. Cancellations and Refunds

• Customers should notify Sandunes Rental Cars as early as possible if they need to cancel or change a booking.
• Cancellation charges, deposit refunds and changes to rental dates will follow the cancellation policy disclosed at the time of booking.
• Refunds will be processed in accordance with the agreed policy and applicable law.
• If Sandunes Rental Cars cannot provide the confirmed vehicle and cannot offer a suitable alternative, the customer will be informed of the available options, including any applicable refund.
• No cancellation fee or non-refundable deposit term will override mandatory consumer rights under Fiji law.

11. Traffic Fines and Other Charges

• The renter is responsible for traffic fines, parking penalties and other charges arising from the renter’s use of the vehicle during the rental period, subject to applicable law.
• Where permitted, Sandunes Rental Cars may provide relevant rental information to the appropriate authorities to process a fine or legal request.
• Any administrative fee for processing fines must be disclosed in the rental agreement before the rental begins.
• The renter must cooperate with reasonable requests relating to incidents or offences occurring during the rental.

12. Personal Belongings

Customers are responsible for their personal belongings left inside the vehicle. Sandunes Rental Cars is not responsible for lost, stolen or damaged personal items except where liability cannot lawfully be excluded.

Customers should check the vehicle carefully before returning it and contact Sandunes Rental Cars promptly if anything is left behind.

13. Privacy and Personal Information

Sandunes Rental Cars may collect and use customer information to manage bookings, verify driver eligibility, process payments, administer the rental agreement, address incidents and meet legal obligations.

Personal information will be handled in accordance with applicable Fiji privacy and data protection requirements. Information will only be shared where reasonably necessary for these purposes or where required or permitted by law.

14. Changes to Bookings and Terms

Any changes to a confirmed booking must be agreed upon by Sandunes Rental Cars and the customer.

Sandunes Rental Cars may update these Terms and Conditions from time to time. Updated terms will be published on the website with a revised date. Changes will not retrospectively remove rights already established under a confirmed rental agreement or applicable law.

15. Complaints and Dispute Resolution

Customers who have concerns about a booking, vehicle or rental charge should contact Sandunes Rental Cars so that the matter can be reviewed.

Both parties should make reasonable efforts to resolve disputes through discussion. If the matter cannot be resolved, either party may pursue the remedies available under applicable Fiji law.

16. Governing Law

These Terms and Conditions are governed by the laws of Fiji. Any dispute will be dealt with by the appropriate courts or other competent bodies in accordance with applicable law.

Acceptance of Terms

By booking or collecting a rental vehicle, the customer acknowledges that they have been given an opportunity to review these Terms and Conditions and agrees to the terms applicable to their rental, subject to their rights under Fiji law.
